Acceptable Use Policy (AUP)

1. Introduction

This Acceptable Use Policy ("AUP" or "Policy") of Rocket Science Corporation (UK) Ltd, and its affiliates ("Multiplay", "we", "our" or "us"), is designed to provide a clear understanding of the rules, regulations, and restrictions on the use of our bare metal server infrastructure, orchestration services, and associated platform services (collectively, the "Services").

Multiplay may, from time to time and at its sole discretion, impose rules, regulations, or restrictions not expressly stated in this AUP. It is the Customer's obligation to maintain and enforce these provisions against all of the Customer's End Users, to maintain its own abuse and postmaster email addresses for reporting abuses, and to promptly and appropriately respond to all communications sent to these addresses.

2. Prohibited Activities

You are prohibited from using Multiplay's Services, directly or indirectly, for any of the following activities:

2.1 Illegal Activities

Engaging in any activity that violates local, state, national, or international laws and regulations, including:

Fraud and Fraudulent Activity

Using the Services for the furtherance of or involvement in any fraudulent activity or fraudulent purpose, including making fraudulent offers to sell or buy products, items or services, or advancing any type of financial scam such as pyramid schemes, chain letters, or any similar financial scam. This includes any use of the Services to effect a misrepresentation or misleading statement, writing, or activity.

Forgery or Impersonation (Phishing)

Adding, removing, modifying, or forging any message header, network header, TCP/IP packet header, or any part of any header or information in any transmission originating or passing through Multiplay's Services in an effort to deceive or mislead another party. This includes impersonating or attempting to impersonate any person or entity, or misleading or attempting to mislead any person or entity by use of incorrect identifying information.

Harm to Minors

Harming minors in any way, or transmitting or storing on a server any child sexual abuse material (CSAM) as defined by applicable law.

2.2 Malicious Activities

Initiating, transmitting, or facilitating any form of malicious software, malware, viruses, ransomware, or other harmful code. This includes the intentional distribution of software, computer code, files, or programs that causes or attempts to cause damage, harassment, or annoyance to persons, entities, data, or computer systems.

2.3 Unauthorized Access

Accessing, corrupting, or taking, or attempting to access, corrupt, or take, any data, information, or accounts of others. This includes logging into a server or account, or entering or using, or attempting to enter or use, another person's or entity's computer system without authorization. Penetrating or attempting to penetrate Multiplay's security measures or those of another person's or entity's computer software, hardware, electronic communications system, or telecommunications system is strictly prohibited, along with any similar activity prohibited by law.

Using Multiplay's Services to transmit or store any information, data, content, material, or work that infringes any copyright, trademark, service mark, patent, trade secret, or other intellectual property right of any person or entity is also prohibited under this section.

2.4 Harassment and Threats

Engaging in any form of online harassment such as cyberbullying, hate speech, or making threats. This extends to the transmission or storage of any material that abuses, threatens, or encourages bodily harm, destruction of property, or any other type of harm, or any material in violation of any duty under any law, contract, or fiduciary relationship.

2.5 Data Breaches

Any unauthorized attempt to access, exfiltrate, or disclose sensitive data, including customer data held on or processed by our infrastructure.

2.6 Intellectual Property Violations

Transmitting or storing any information, data, content, material, or work that infringes any copyright, trademark, service mark, patent, trade secret, or other intellectual property right of any person or entity.

2.7 Network Abuse

Interfering with, disrupting, or adversely affecting, or attempting to interfere with, disrupt, or adversely affect, the ability to use Multiplay's Services, the Internet, or any other services or equipment. This includes, without limitation, Denial-of-Service (DoS) attacks against another network, host, or individual user. Additionally, the following are prohibited: using the Services to interfere with, disrupt, or adversely affect the service of any other customer, end user, host, network, or system by means including but not limited to overloading, flooding, email bombing, news bombing, or crashing; impeding another person's use of electronic mail services or news; or using any program or sending messages designed to interfere with or disable a user's session.

3. Fair Use

In addition to the above prohibitions, Multiplay enforces a Fair Use Policy to ensure equitable access to our Services for all Customers. Excessive and unreasonable use of network resources may result in action, including throttling or suspension of service. This policy promotes responsible and equitable resource utilization.

We assess compliance by evaluating average monthly bandwidth usage over a twelve-month period. Should the usage of our Services exceed the typical patterns for game hosting or deviate from the customary behaviour of our customer base, it may be categorised as excessive and/or unreasonable.

Our Fair Use Policy defines the following bandwidth allocations, aggregated per geographical location:

If your usage is flagged as excessive and/or unreasonable, we may contact you to discuss a potential breach. We may request your collaboration in adjusting your game hosting usage accordingly. Should excessive and/or unreasonable usage persist following the adjustment period, we may assess charges on your account without prior notification. We reserve the right to suspend, modify, or restrict the use of Services in case of policy breaches.

4. Zero Spam

Multiplay is committed to maintaining a clean email environment and we prohibit the use of our Services for spam-related activities. Engaging in activities that contravene the Privacy and Electronic Communications Regulations 2003 (PECR), the UK General Data Protection Regulation (UK GDPR), the CAN-SPAM Act of 2003, or any other applicable legislation governing electronic communications constitutes a breach of this AUP.

Should a Customer host websites or services on their server that support spammers or result in the inclusion of Multiplay's IP addresses in spam databases (such as SpamHaus) or black hole lists, their Service will be promptly disconnected following a 24-hour warning period. We do allow the Customer an opportunity to remedy the violation before service suspension takes effect. If the listing database incurs a de-listing fee, the costs (starting at a flat fee of $125.00) will be charged to the Customer.

5. Disclosure to Law Enforcement

Occasionally, Multiplay may be required by law to submit customer information to law enforcement officials when presented with a valid court order or other lawful request from a court or authority with proper jurisdiction. Information requested is disclosed as directed pursuant to the relevant order or request. Multiplay takes great care in keeping customer information safe and private and will only release information as required by law.

Multiplay will notify the customer of any information request where it is legally permitted to do so. Please consult a legal adviser if you are uncertain of the legal status of any of your activities.

6. Reporting Violations

If you believe that someone is using Multiplay's Services in violation of this AUP, please report it to our abuse team at abuse@multiplay.dev. Reports of alleged violations must be verified and should include:

  • The reporter's name and contact information

  • The IP address involved

  • A description of the violation

We take all reports seriously and will investigate promptly.

7. Consequences of Breach

Failure to comply with this AUP may result in one or more of the following actions, at Multiplay's sole discretion:

  • A formal warning regarding the violation and potential consequences

  • Temporary suspension of Services pending investigation

  • Termination of Services for serious or repeated violations

  • Disclosure of information to law enforcement agencies and/or legal action against the Customer for breach of this Policy, including but not limited to claiming all costs, fees, and disbursements (including legal fees) connected therewith

9. Changes to This Policy

Multiplay may update this Acceptable Use Policy from time to time in response to changing legal, technical, or business developments. The most recent version will be posted on our website, and such modification shall become immediately effective upon posting. The date of the last update will be indicated at the beginning of this document.
